Reese Witherspoon and Husband Jim Toth Arrested, Jailed for DUI Incident

Reese Witherspoon and Jim Toth were arrested on Friday morning after the Oscar-winning actress began arguing with a police officer after her husband had been detained for driving under the influence of alcohol.

“Mrs. Witherspoon began to hang out the window and say that she did not believe that I was a real police officer,” Trooper First Class J. Pyland wrote in a report. “I told Mrs. Witherspoon to sit on her butt and be quiet.”

Witherspoon, 37, did not react after his order, getting out of the Ford Fusion instead. When the trooper made one more warning, Witherspoon allegedly told him she was a U.S. citizen and allowed to “stand on American ground.”

“I put my hands on Mrs. Witherspoon’s arms to arrest her,” Pyland wrote. “Mrs. Witherspoon was resistant but I was able to put handcuffs on her without incident due to Mr. Toth calming her.”

“Do you know my name?” he said Witherspoon asked. “I answered, ‘No, I don’t need to know your name.'” “You’re about to find out who I am,” she replied, the arrest report claims.

Pyland stopped Toth, 42, after seeing him drunk and as he was weaving in out of his lane as he drove through the city’s Buckhead community.

According to the police report, the driver’s eyes were bloodshot and his clothing disheveled. After several tests had been conducted, he was given a breathalyzer test that registered 0.139, well above the legal limit of 0.08 for a driving under the influence charge, reports CNN.

Their car was impounded, and the celebrity couple were taken to the Atlanta city jail. An unidentified passenger in the back seat caught a cab, report said.

Witherspoon and her husband were bailed out of jail Saturday morning. A court date is set for Monday morning.

Having had time to sober up, the Hollywood star apologized profusely in a statement for her behavior.

“But I do want to say, I clearly had one drink too many and I am deeply embarrassed about the things I said. It was definitely a scary situation and I was frightened for my husband, but that is no excuse. I was disrespectful to the officer who was just doing his job. I have nothing but respect for the police and I’m very sorry for my behavior.”

The blond is charged with disorderly conduct for getting into a verbal fight with the police officer. Toth, whose blood alcohol level exceeded the set legal limit, has been charged with driving while intoxicated.

The couple had been down in Atlanta for work on the film “The Good Lie.” They were married in March 2011 and welcomed their first child together, son Tennessee James, in September.

The actress won a shelf full of awards for her performance as June Carter Cash in “Walk the Line,” including a best actress Academy Award.

Representatives for Witherspoon did not immediately respond to the media’s requests to comment on the issue.
