According to Extra, the former couple may have been secretly married. The Montreal-born model referred to Berry as his “ex-wife” in court papers he filed Monday aiming to obtain a restraining order against her current fiancé, French actor Olivier Martinez.
The Bond’s girl’s ex filed the request for protective order after getting into an altercation with her current fiancé. “Respondent is the fiance of my ex-wife, Halle Berry,” so he stated in the court documents.
Gabriel also tried to overturn an order banning him from seeing Nahla, but he was rejected. A judge had previously issued a protective order barring Berry’s ex from getting less than 100 yards (100 metres) from the Hollywood star, Martinez and Nahla. It initially ran until December 3, but there’s a clerical error that made it valid only for two more days.
The 37-year-old model is scheduled to appear in court on December 13 after he was taken into custody on suspicion of misdemeanor battery. He was released from jail after posting $20,000 bail. Contrary to Olivier’s testimony, he insisted he’s not the one who started the fistfight.
Aubry claimed Berry’s new boyfriend ambushed him when he walked to his car to close his door. “Mr. Martinez jumped on me on the side of my body, and punched me such that he had taken me down to the ground,” he claimed.
“He continued to punch me at least two or three times, kicked me in the ribs with his knee or foot, and took my head in his hands and slammed it to the concrete driveway. It all happened so suddenly, I did not see Mr. Martinez’s actions coming, and thus, I was not ready for it and was not able to defend myself.”
Gabriel also suggested that Olivier was angry with the way things turned out in the custody battle between the model and Halle. “While he was attacking me physically, Mr. Martinez said to me in an aggressive and threatening voice, ‘You cost us $3 million’,” he said.
A judge has forbade Halle to move to France with her daughter unless Gabriel moves there s well. Gabriel remembered Olivier’s threat, “When you see the judge, you’re going to tell him you’re going to Paris or I’m going to kill you. You’re going to Paris, you’re going to get your 20 grand a month in child support. From now on you’re going to do drop-offs on the street.'”
Berry’s ex also recollected his alleged encounter with the 46-year0old actor a day before the altercation when he took Nahla to her school play.
“Martinez, who seemed very angry and agitated, suddenly started speaking to me in French, and spouted off things such as, ‘I wish I could beat the s**t out of you right now. You’re lucky we’re in a school right now.’”
Berry gave birth to Nahla four years ago after meeting Aubry at a Versace photo shoot in 2005. The two split in April 2010. Soon after their breakup, the Oscar-winning actress told Vogue that she and Aubry hoped to work out a peaceful custody arrangement.
“We were meant to bring this amazing little person into the world. And I think that’s why we came together. And because of that, we are going to be together forever,” she said at the time. “We are a family until we are not here anymore.”
After a bitter court war, the couple came to what had appeared to be an amicable agreement. “Our issues were never about fighting for her,” Berry said at the time of her daughter. “We both know a child needs both her parents.”
“But what I want to say about it is sometimes, as a couple, you reach an impasse. We needed a court and a judge to help us work out some of the delicate issues, and I’m so happy we’ve arrived at that place.”
