Los Angeles Superior Court Judge Elden S. Fox sentenced actress Lindsay Lohan on Friday back to jail for nearly a month as promised after a failed drug test and she joins a long list of celebrities who have fallen foul of the law.
Judge Elden Fox ordered Lohan to be jailed immediately after the hearing that lasted less than 10 minutes. Her next court appearance was set for October 22, with no bail set.
When Lohan’s attorney, Shawn Chapman Holley asked to argue that bail should be set, Fox’s reply was simple: “Nope.” Bailiffs closed in and Lohan stood up. Her estranged father, Michael, said “Oh God,” as she was handcuffed and solemnly led from the courtroom.
Within moments Lohan was stripped of her designer high-heel shoes and jewelry and on her way to the county women’s jail, where she will be held in an isolation unit. Her mother, Dina, carried the items in a clear plastic bag from the courtroom after the hearing.
His decision came as a shock to Lohan’s team because they believed she couldn’t be held without bail on misdemeanor charges. “I think that the case law is clear, that she is entitled to bail. That’s all,” Shawn Chapman Holley said.
Hours later, she was back at the courthouse. A source said she planned to file a writ of habeas corpus, which would argue Lohan was unlawfully imprisoned.
Lohan, 24, has admitted she failed the drug test within weeks of her release from a court-ordered rehab program, testing positive for cocaine.
It will be Lohan’s third jail stint for a three-year-old drug and drink-driving case filed after a pair of high-profile arrests in 2007.
Her first visit lasted just 84 minutes, while her most recent was 14 days, half the sentence handed down by the judge – because of jail overcrowding.
When he freed her after 23 days of rehab this summer, Judge Elden Fox threatened to jail Lohan for 30 days in jail for every failed or missed drug test.
Because of overcrowding, it’s likely she would get released early again – so holding her without bail until she’s actually sentenced is one way for the judge to make sure she does the time.
Before she headed to Fox’s Beverly Hills courtroom, Lohan thanked her fans for their support. “Awesome responses,” she posted on her Twitter page, referring to fan comments on another social networking site called Chime. “You guys are so great.”
Lohan acknowledged failing a court-ordered drug test on her Twitter page last week. She sounded contrite, but Us Weekly reports that she was drinking cocktails when she wrote the confession.
She reportedly crafted the statement on her BlackBerry at the Magnolia restaurant in Hollywood, where a witness claims to have watched the actress laugh and guzzle down whiskey and Cokes as she typed away.
An assistant and male friend coached her on how to make the statement sound “more personal,” the mag said.
“Her friend would say, ‘No, use ‘setback,’ don’t say ‘mistake.’ They’ll say you make mistakes all the time!” the spy said, adding that the friend went on, “It’s better to say you’re responsible. Denying it will just get everyone mad per usual.” [via NY Daily News and Daily Telegraph (UK)]
